Why Would A Person Need To File A Relocation Form With The Court?

If you have or are seeking parenting time, grandparent visitation, or custody of a child, you must make sure certain other people know what your home address is and other contact information. The people you must inform include anyone else that has or is seeking parenting time, grandparent visitation, or custody of the child. Review I.C. 31-17-2.2-0.5. A non-relocating parent (a parent not moving or changing their address) must usually respond.

Must A Person With Parenting Time, Or Who Is Seeking Parenting Time, File A Relocation Form When They Are Going To Move?

Not necessarily. You may not have to file a notice if:

  1. The move will shorten the distance between your home and the non-relocating person’s home OR the move will not increase the distance between your home and the non-relocating person’s home by more than 20 miles and
  2. Will allow the child to remain enrolled in the child’s current school.
How Much Time Does A Non-Relocating Person Have To Respond?

If you have or are seeking parenting time, grandparent visitation, or custody of a child and you have given notice that you intend to relocate, the non-relocating person has 20 days after getting notice from you to respond if they have any objection to the move. Review Indiana Code 31-17-2.2-5
